These Terms of Service ("Terms") govern your access to and use of the Clymb platform, applications, and related services (the "Services"). By using the Services you agree to be bound by these Terms.

1. Acceptance of Terms

Your use of the Services constitutes acceptance of these Terms and our Privacy Policy. If you do not agree, you must discontinue use.

2. Eligibility

You must be at least 16 years old and have the legal authority to enter into these Terms. Users creating an account on behalf of an organization represent they have proper authorization.

3. Accounts & Security

You are responsible for safeguarding credentials and for activity under your account. Notify us immediately of unauthorized access.

4. Licensed Use & Restrictions

We grant a limited, revocable, non-transferable license to access the Services for lawful, internal career or talent management purposes. You may not reverse engineer, scrape at scale, misuse rate limits, or interfere with platform integrity.

5. User Content

You retain ownership of content you submit (resume data, profile information, job postings). You grant us a worldwide, royalty-free license to process that content solely to provide and improve the Services.

6. AI Insights & Limitations

Insights, benchmarks, or valuations are generated algorithmically and are informational only; they do not constitute financial, legal, or HR advice. Outcomes are probabilistic and may differ from real-world results.

7. Fees & Billing

Paid plans, if applicable, will be billed according to the pricing presented at checkout or on the Pricing page. Taxes may apply. We may change fees with reasonable notice; continued use constitutes acceptance.

8. Privacy

Our data practices are described in the Privacy Policy. By using the Services you consent to those practices.

9. Prohibited Conduct

  • Attempting unauthorized access or security testing without permission
  • Automated data extraction beyond reasonable personal use
  • Uploading unlawful, infringing, or malicious content
  • Misrepresenting identity or affiliation
  • Interfering with normal operation or burdening infrastructure

10. Intellectual Property

All platform software, models, designs, and content (excluding User Content) are owned by or licensed to Clymb and protected by intellectual property laws. No rights are granted except as expressly stated.

11. Third-Party Services

Integrations (e.g., LinkedIn) are provided for convenience and governed by third-party terms. We are not responsible for third-party actions or policies.

12. Suspension & Termination

We may suspend or terminate access for violation of these Terms or to protect platform integrity. You may stop using the Services at any time. Sections intended to survive termination will continue.

13. Disclaimers

The Services are provided "AS IS" without warranties of any kind, express or implied, including accuracy, suitability, or non-infringement. Data outputs are not guarantees of future outcomes.

14. Limitation of Liability

To the fullest extent permitted by law, Clymb will not be liable for indirect, incidental, consequential, or punitive damages, or loss of profits, data, or goodwill. Aggregate liability will not exceed amounts paid in the 12 months preceding the claim (or $50 if none).

15. Indemnification

You agree to defend and indemnify Clymb against claims arising from (a) your use of the Services, (b) violation of these Terms, or (c) infringement of third-party rights by your content.

16. Governing Law

These Terms are governed by the laws of the jurisdiction disclosed upon account creation (default: United States / Delaware), excluding conflict of laws principles. Venue for disputes will be specified jurisdiction courts.

17. Changes to Terms

We may update these Terms periodically. Material changes will be communicated (e.g., in-app notice or email). Continued use after effective date constitutes acceptance.
